1. Supplier Identification and Scope of Service
The car rental service is provided under the Invernalia Rent A Car brand. The service may actually be provided by different operating companies, depending on the country, city, branch, or location where the customer makes the reservation, picks up the vehicle, or contracts the service.
In each case, the contractual provider will be the operating company corresponding to the applicable rental location, whose legal, tax, and contact information will be provided to the customer during the reservation process, in the reservation confirmation, in the rental agreement, in the corresponding tax documentation, and/or in any other applicable contractual document.
Invernalia LLC, incorporated in the State of Florida, United States of America, may act as an affiliated company, trademark owner, international commercial platform, and/or operational support entity, as applicable, without prejudice to the fact that the provision of services and the contractual relationship with the customer are established directly with the local operating company in each case.
References to “Winterfell,” “the company,” or “the firm” contained in these Terms and Conditions shall be understood to refer to the operating company acting as the contractual provider for the specific transaction, depending on the location where the service is provided.
2. Requirements for picking up the vehicle
When picking up the vehicle, the primary driver must present the following documents:
- National Identity Card, passport, or other valid document issued by a competent authority.
- A physical, valid driver’s license that authorizes the driver to operate the category of vehicle being rented. A digital version may be accepted only as a supplement, unless applicable regulations expressly provide otherwise.
- A Visa, Mastercard, or American Express credit card issued in the name of the primary driver, with sufficient funds and available credit to cover the security deposit, the applicable deductible, and any other charges authorized under these Terms and Conditions. Debit cards and cash are not accepted as security, unless expressly authorized by INVERNALIA.
The minimum age to drive is 18, unless the vehicle category, applicable insurance, jurisdiction, or current commercial policy requires a higher age. This requirement applies to the primary driver and all additional drivers.
Failure to meet any of the specified requirements may prevent the vehicle from being delivered, without prejudice to any applicable charges under the cancellation, no-show, or missing documentation policies applicable to the case.
3. Deductibles, Security Deposits, and Vehicle Categories
The deductible is the maximum amount the customer is responsible for in the event of damage, loss, theft, or destruction of the vehicle, provided that the event is covered under the policy and the customer has fulfilled the obligations set forth in the contract. The deductible does not limit the customer’s liability in cases excluded from coverage, material breach, willful misconduct, gross negligence, misuse, driving under the influence of alcohol or prohibited substances, serious traffic violations, or any other case expressly excluded.
The deductible amounts, security deposit, and vehicle categories will be provided during the reservation process and/or in the rental agreement. For reference purposes, the following categories and deductibles may apply, subject to commercial updates and validation at the time of signing the contract:

In the event of a discrepancy between the preliminary information and the rental agreement signed at the time of pickup, the specific terms and conditions actually communicated to and accepted by the customer in the agreement shall prevail, provided that they comply with applicable regulations and do not result in an undisclosed reduction of rights previously offered.
4. Insurance, Coverage, and Exclusions
4.1. Basic CDW Coverage
Unless otherwise expressly stated, the rental rate includes partial collision coverage (CDW), third-party liability insurance in accordance with the applicable policy, and coverage for theft or robbery of the vehicle, all subject to the applicable deductible, contractual exclusions, and the terms of the current policy.
CDW Basic Coverage does not waive the deductible. The customer will be liable up to the amount of the applicable deductible for covered damage, theft, or loss, unless they have purchased optional coverage that reduces or waives that deductible.
4.2. Premium CDW Coverage
Premium CDW Coverage is optional and is not included in the base rate, unless otherwise specified. Purchasing this coverage reduces the base deductible by 50%, unless the reservation or contract specifies a different reduction.
Premium CDW Coverage may include, subject to current terms and conditions: protection for the windshield, windows, and locks; roadside assistance in the event of an accident or mechanical breakdown; reasonable charges for the vehicle’s downtime during repairs; and administrative fees related to such events.
Premium CDW Coverage does not mean a zero deductible and does not cover damage resulting from gross negligence, reckless or careless conduct, fuel error, driving under the influence of alcohol or prohibited and/or controlled substances, unauthorized use of the vehicle, serious traffic violations, intentional damage, or any other situation expressly excluded.
4.3. Total Coverage — Full Insurance
Full Coverage (Full Insurance) is optional and is not included in the base rate, unless otherwise specified. Purchasing this coverage may reduce the deductible to USD 0 for covered damages, in accordance with the terms of the rental agreement and the applicable insurance policy.
Total Coverage may include damage to the body, roof, undercarriage, mirrors, windows, wheels, tires, hubcaps, engine, clutch, battery, windshield, glass, locks, roadside assistance, administrative expenses, and immobilization fees, provided that the event is covered and does not constitute an exclusion.
Total Coverage does not cover damages or liabilities arising from willful misconduct, gross negligence, grossly negligent, reckless, or imprudent conduct, misuse of the vehicle, fuel error, driving under the influence of alcohol, drugs, or prohibited and/or controlled substances, participation in competitions, use outside authorized routes, unauthorized border crossings, serious traffic violations, failure to report an accident, abandonment of the vehicle, handing the vehicle over to an unauthorized driver, or any other serious breach of the contract.
4.4. Common Exclusions
All coverage is subject to the exclusions set forth in these Terms and Conditions, in the rental agreement, and in the applicable insurance policy. In excluded cases, the customer will be liable for all damages, losses, expenses, fines, charges, repair costs, reasonably substantiated loss of profits, and vehicle downtime, without any deductible limit, to the extent that they are applicable and properly documented.
5. Liability for Traffic Violations
The customer and any authorized driver will be liable for traffic violations committed during the rental period, including speeding, running a red light, illegal parking, driving in restricted areas, violations captured by cameras, unpaid tolls, fees, administrative charges, and any other violations attributable to the use of the vehicle.
INVERNALIA may charge the amount of any fine, fee, toll, government charge, or related expense to the registered credit card, along with an administrative processing fee of USD 100 for each violation or incident, or the equivalent in local currency, provided that the charge is disclosed and supported by sufficient documentation.
The administrative fee covers tasks related to identification, document management, internal administration, communication with authorities, and the processing and follow-up of the violation. The application of this fee does not preclude INVERNALIA from claiming other reasonable damages or costs, duly substantiated, if the incident results in further harm.
6. Driving under the influence of alcohol, drugs, or other substances
Driving under the influence of alcohol, drugs, psychoactive substances, or any substance that impairs one’s ability to drive constitutes a material breach of the contract. In such a case, INVERNALIA may terminate the contract, demand the immediate return of the vehicle, void the coverage purchased with respect to the event related to the breach, collect for any damages and expenses incurred, and apply an additional administrative fee of USD 200, or its equivalent in local currency, without prejudice to any fines, penalties, or legal liabilities that may apply.
The application of these consequences will be subject to the existence of objective evidence, intervention by the competent authority, documentation of the event, acknowledgment by the customer, or any other reasonable means of verification.
7. No Smoking
Smoking is prohibited inside the vehicle. This prohibition applies to cigarettes, cigars, pipes, e-cigarettes, vapes, and any other device used for burning, vaporizing, or consuming tobacco or similar substances.
If, at the time of return, reasonable signs of non-compliance are detected—such as a persistent odor, ash, residue, burn marks, stains, or any other verifiable indicator— INVERNALIA may apply a cleaning, deodorizing, and sanitizing fee of USD 200, or its equivalent in local currency. This fee is separate from any physical damage that may be identified and claimed separately, with supporting documentation.
8. Delivery, Returns, and Delays
The customer must pick up and return the vehicle on the date, at the time, and at the location specified in the reservation and in the rental agreement. A 59-minute grace period is granted for return, unless the reservation or the branch has a different policy that was previously communicated.
Once the grace period has expired, INVERNALIA may apply late fees, including an additional daily rate, extension fees, operating costs, and expenses incurred due to the impact on subsequent reservations. If the customer does not obtain express authorization to extend the rental, they will be liable for any damages, fines, costs, or losses incurred during the unauthorized period.
The coverage provided applies only to the authorized rental period. Failure to return the vehicle on time may affect coverage if the incident occurs outside the contracted period and no extension has been approved by INVERNALIA or the insurer, in accordance with the applicable terms and conditions.
9. Right to refuse to hand over the vehicle
The company may refuse to deliver the vehicle when there are reasonable and well-founded grounds based on safety, fraud prevention, or operational risk criteria, including—but not limited to—the following circumstances:
- Failure to submit the required documentation in its entirety and in good standing.
- Insufficient funds or inability to post the security deposit.
- Inconsistencies, irregularities, or reasonable doubts regarding the authenticity or validity of the documentation submitted.
- Objective circumstances that raise legitimate doubts about the customer's identity or the legality of the transaction.
- Behaviors that endanger the safety of personnel, the vehicle, or third parties.
- Reasonable grounds to believe that the customer is under the influence of alcohol or substances that could impair driving.
- The customer exhibits aggressive, intimidating, or fraudulent behavior.
The authority provided for in this clause shall be exercised in accordance with the principles of reasonableness, good faith, and dignified treatment, depending on the circumstances of the case.
Economic Consequences
If delivery of the vehicle is denied:
- When the cancellation is attributable to the customer (due to failure to meet requirements or provide documentation), the company may apply the penalties established for cancellations or “no-shows.”.
- When the refusal is based on preventive security or verification reasons, the company may withhold reasonable administrative fees and must refund the remaining balance to the customer within a reasonable period of time.
10. Authorization of Card Charges and Debits
The customer authorizes INVERNALIA to block, pre-authorize, and/or charge the registered credit card for the items expressly provided for in these Terms and Conditions, in the reservation, and in the rental agreement, including:
- security deposit and applicable deductible;
- rental rates, extensions, extras, and category differences;
- fines, traffic violations, tolls, fees, and administrative processing charges;
- damage, loss, theft, pilferage, destruction, immobilization, and duly verified repair costs;
- low fuel, refueling service, deep cleaning, sanitization, and interior damage;
- additional equipment that has been lost, damaged, or not returned;
- fees for late payment, no-shows, late cancellations, or expressly stipulated breaches of contract.
Except for charges that have been accepted and verified at the time of the return, INVERNALIA will endeavor to notify the customer by email or other specified means, providing details of the charge and supporting documentation. The customer may submit comments through the designated customer service channels; however, this will not prevent the collection of charges that are valid, enforceable, and documented.
The authorization granted does not cover charges not specified in the contract or items not disclosed. In the event of a dispute, INVERNALIA reserves the right to seek payment of the applicable amounts through judicial or extrajudicial means.
11. Inspection and Damage Procedure
At the time of delivery, INVERNALIA may document the vehicle’s condition using a checklist, photographs, video, digital records, or any other reasonable means. The customer must inspect the vehicle and report any damage, missing items, anomalies, or unrecorded discrepancies before picking it up.
Upon return, the vehicle will be inspected by INVERNALIA. Any visible damage may be noted at that time. Hidden damage—whether mechanical, structural, internal, to the undercarriage, tires, rims, engine, clutch, battery, electrical system, or other components—may be reported at a later date, within a reasonable timeframe, accompanied by technical or documentary evidence when applicable.
The customer shall be liable for any damage caused during the rental period, up to the applicable deductible or without any deductible limit in cases excluded from coverage or in the event of a material breach. INVERNALIA may use estimates, invoices, technical reports, photographs, telemetry records, reports, complaints, communications from insurers, or other reasonable means to substantiate the damage and its cost.
12. Cancellations, No-Shows, and Changes
- Cancellations made more than 48 hours before the pickup time: no charge, except for non-refundable expenses, taxes, fees, or third-party charges that have been duly disclosed.
- Cancellations made less than 48 hours in advance: INVERNALIA may charge the full amount of the reservation, taking into account blocked availability, operating costs, and loss of business opportunity, unless the customer has purchased an applicable flexible cancellation add-on.
- No-Show: If a guest fails to arrive at the agreed-upon time and location without a valid prior cancellation, INVERNALIA will be entitled to charge the full amount of the reservation, in addition to any additional fees that have been duly disclosed.
- Reservation changes: Subject to availability, rate differences, vehicle class, season, pickup/drop-off location, and current terms and conditions.
13. Fuel Policy
The vehicle will be delivered with the fuel level indicated at the time of delivery. The customer must return it with an equivalent fuel level. Any shortfall may be charged at the prevailing market price per liter at the time of return, plus a reasonable refueling service fee as determined by INVERNALIA.
14. Mileage
Rentals include unlimited mileage, unless the reservation confirmation or rental agreement expressly states a limit. If a limit applies, any excess kilometers will be charged according to the rate provided at the time of booking.
15. Additional Drivers
Additional drivers must be declared, approved, and added to the rental agreement before driving the vehicle. All drivers must present a valid driver’s license, provide the required documentation, and meet the applicable minimum age requirement. Driving by an unauthorized person constitutes a serious breach of contract and may affect the coverage provided under the agreement.
16. Crossing borders and using the vehicle outside the country where it was rented
The customer may not remove the vehicle from the country of rental without INVERNALIA’s prior and express authorization and without the corresponding documentation. Authorization is subject to the vehicle category, destination country, insurance, permits, season, applicable charges, and operational restrictions. Unauthorized border crossing constitutes a serious breach of contract and may void coverage for events occurring outside the authorized territory.
17. Arrival by plane
Customers arriving on a commercial flight must provide their flight number at the time of booking. INVERNALIA will make every effort to accommodate reported delays within its operating hours and subject to branch availability. Failure to provide flight information or timely notification may result in the application of the no-show policy or rescheduling subject to availability.
18. Extension of the Lease
Any rental extension must be requested before the contract expires and will be subject to availability, authorization by INVERNALIA, applicable coverage, rate adjustments, and the signing or acceptance of the corresponding extension. Retaining the vehicle without authorization may result in additional charges, liability for damages, and a reduction in coverage.
19. Additional Services and Equipment
Optional extras, including child seats, GPS, snow chains, devices, or similar equipment, are subject to availability and additional charges. The customer is liable for any loss, damage, theft, or failure to return the additional equipment. The installation and use of child restraint systems are the customer’s responsibility, unless applicable regulations impose a specific obligation on INVERNALIA.
20. Cleaning, Proper Use, and Return
The vehicle must be used with care and returned in reasonable condition in terms of cleanliness and maintenance, taking into account normal use of the service. INVERNALIA may charge fees for deep cleaning, sanitization, and the removal of stains, odors, debris, excessive mud, pet hair, spills, or any other condition that exceeds ordinary use, provided that such condition is verified and documented.
21. Currency, Taxes, and Conversion
Amounts may be expressed in U.S. dollars (USD) for commercial reasons, based on vehicle category, operating market, or as an international reference. When payment is to be made in local currency, the exchange rate, taxes, fees, levies, bank charges, and payment terms in effect at the time of the transaction will apply, in accordance with applicable regulations and as communicated to the customer.
Charges may be billed and/or debited in local currency (Argentine pesos or the legal tender of the country where the service is provided), using the following conversion rate:
The selling exchange rate reported by the Banco de la Nación Argentina for transactions not involving financial institutions (“BNA selling exchange rate”) in effect at the time the corresponding charge is processed will be used.
If Banco de la Nación Argentina does not publish an exchange rate applicable at the time the charge is processed, the selling exchange rate reported by another leading bank in the country where the transaction takes place may be used as a reference.
The resulting amounts may include taxes, levies, fees, or surcharges applicable under current regulations, which will be passed on to the customer to the extent applicable.
The customer hereby declares that he or she is aware of and accepts that:
- Charges may be assessed after the rental period ends, depending on the results of an inspection for damage, fines, or other items specified in the contract;
- The applicable exchange rate will be the rate in effect at the time the charge is actually processed;
- Any differences resulting from exchange rate fluctuations shall not give rise to any claims.
22. Personal Information
The customer authorizes the processing of their personal data, documentation, contact information, payment information, license information, images, vehicle-related records, and any other information necessary to manage the reservation, fulfill the contract, comply with legal obligations, process insurance, handle traffic citations, prevent fraud, process payments, and address complaints. INVERNALIA must process such information in accordance with applicable regulations regarding the protection of personal data.
23. Handling Complaints and Communications
Communications with the customer will be sent via email, phone, mailing address, or the channel provided at the time of booking. Complaints, comments, or requests must be submitted through [●]. INVERNALIA may request additional information to review the complaint and provide a well-founded response.
24. Governing Law and Dispute Resolution
This contract shall be governed by the laws applicable in the jurisdiction where the service is provided, without prejudice to any applicable mandatory consumer protection laws. No provision of these Terms and Conditions shall be construed as a waiver, limitation, or displacement of inalienable rights recognized by applicable law.
In the event of a dispute, the parties shall first attempt to resolve it through INVERNALIA’s customer service channels. Where a consumer relationship applies, the administrative, conciliation, or judicial mechanisms provided for by current regulations shall apply.
25. Acceptance
Upon completing the reservation, picking up the vehicle, or signing the rental agreement, the customer declares that they have received sufficient information regarding the essential terms of the service, rates, deductibles, coverage, exclusions, charges, security deposit, cancellation policy, liabilities, and other applicable terms. Acceptance may be effected through physical, digital, electronic, or any other valid means in accordance with INVERNALIA’s standard business practices.
